 Serving Greenville & the Upstate of South Carolina
This Waiver, Release, Hold Harmless & Damage Responsibility Agreement (“Agreement”) is entered into between Turf Wars Game Rental (“Turf Wars”) and the undersigned customer (“Customer”) in connection with the rental and use of recreational games and equipment provided by Turf Wars.

1. ASSUMPTION OF RISK
Customer understands that outdoor games and recreational equipment may involve inherent risks, including but not limited to:
Slips, trips, falls, and uneven or slippery ground;
Collisions with people, equipment, structures, or other objects;
Strains, sprains, cuts, bruises, and other bodily injuries;
Injury resulting from throwing, catching, swinging, tossing, or otherwise interacting with game equipment;
Injury resulting from improper, careless, reckless, or unauthorized use of equipment;
Weather-related conditions, including heat, rain, wind, lightning, or other environmental conditions;
Injury to children or other participants who are not appropriately supervised; and
Property damage resulting from the use, movement, placement, or storage of rental equipment.
Customer voluntarily assumes responsibility for the risks associated with the use of the rented equipment and agrees to ensure that all participants use the equipment in a safe and appropriate manner.

2. RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, Customer, on behalf of themselves and their participating guests, attendees, family members, and invitees, releases and agrees not to hold Turf Wars Game Rental, its owners, employees, agents, representatives, contractors, and affiliates responsible for claims, demands, losses, damages, injuries, or expenses arising from or related to the use of the rented equipment, except to the extent such liability cannot lawfully be waived or released.
This release applies to injuries, damages, or losses arising from the ordinary risks associated with participation in recreational activities and use of the equipment.
Nothing in this Agreement is intended to release or waive liability that cannot legally be released or waived under applicable law.

3. HOLD HARMLESS & INDEMNIFICATION
Customer agrees to indemnify, defend, and hold harmless Turf Wars Game Rental, its owners, employees, agents, representatives, contractors, and affiliates from claims, liabilities, damages, losses, costs, and reasonable expenses arising out of:
Customer's or any participant's misuse, abuse, negligent use, or unauthorized use of the rental equipment;
Customer's failure to follow the provided instructions or safety requirements;
Customer's failure to properly supervise children or other participants;
Damage to property caused by Customer or any participant;
Injuries or damages caused by the acts or omissions of Customer or any participant; or
Customer's violation of the terms of the rental agreement.
This provision does not require Customer to indemnify Turf Wars for liability that cannot legally be shifted to Customer.

4. CUSTOMER RESPONSIBILITY FOR EQUIPMENT
Customer accepts responsibility for the rental equipment from the time of delivery or pickup until the equipment is returned to Turf Wars or collected by Turf Wars.
Customer agrees to:
Use the equipment only for its intended purpose;
Follow all instructions provided by Turf Wars;
Keep equipment in a safe and appropriate location;
Prevent unauthorized persons from using the equipment;
Keep equipment away from roads, vehicles, fire, pools, bodies of water, and other hazardous areas;
Not modify, alter, repair, disassemble, or otherwise change the equipment;
Not move equipment to another location without permission from Turf Wars;
Protect equipment from unreasonable exposure to damage, theft, or loss; and
Notify Turf Wars immediately if equipment becomes damaged, lost, stolen, or unsafe to use.

5. DAMAGE, LOSS, OR THEFT

Turf Wars will make reasonable efforts to document any damage and communicate applicable repair or replacement charges to Customer.

6. NORMAL WEAR & TEAR
Customer will not be responsible for ordinary wear and tear resulting from normal and intended use of the equipment.
Turf Wars will determine whether damage constitutes ordinary wear and tear or damage requiring repair or replacement, subject to applicable law.

7. SUPERVISION OF CHILDREN
Many Turf Wars games are intended for use by children and families. Customer acknowledges that Turf Wars does not provide childcare, supervision, or event attendants unless specifically agreed upon in writing.
Customer is responsible for supervising children and other participants and for determining whether a particular game or piece of equipment is appropriate for each participant based on age, size, ability, and circumstances.

8. SAFE USE OF EQUIPMENT
Customer agrees that all participants will:
Use equipment only as intended;
Follow posted or provided rules;
Avoid dangerous, reckless, or inappropriate behavior;

Stop using equipment if it becomes damaged or unsafe; and
Immediately report any injury, dangerous condition, or equipment malfunction to the Customer and Turf Wars.
Turf Wars reserves the right to instruct Customer or participants to stop using equipment if Turf Wars reasonably believes the equipment is being used in an unsafe manner.

9. WEATHER & OUTDOOR CONDITIONS
Customer acknowledges that many Turf Wars games are designed for outdoor use and may be affected by weather and ground conditions.
Customer agrees to use reasonable care in protecting rental equipment from severe weather, excessive rain, flooding, high winds, lightning, extreme heat, or other conditions that could damage the equipment or create an unsafe environment.
Customer must follow any weather-related instructions provided by Turf Wars.

10. DELIVERY, SETUP & PICKUP
Unless otherwise agreed in writing, Customer is responsible for providing Turf Wars with reasonable access to the delivery, setup, and pickup location.
Customer is responsible for informing Turf Wars of any conditions that may affect delivery or setup, including:

Locked areas;
Landscaping or other obstacles;
Restricted-access locations; or
Other conditions that could make delivery or retrieval difficult or unsafe.
Turf Wars reserves the right to decline placement of equipment in an area that it reasonably determines is unsafe or unsuitable.

11. PROPERTY DAMAGE
Customer is responsible for selecting an appropriate location for the equipment and agrees to disclose any known hazards that could reasonably result in damage to the equipment or surrounding property.
Turf Wars is not responsible for damage to lawns, landscaping, flooring, driveways, patios, decks, fences, or other property resulting from ordinary placement or use of rental equipment, except to the extent such liability cannot legally be excluded.
Customer is responsible for damage to the rental equipment caused by placing, using, moving, or storing the equipment in an inappropriate location.

12. PARTICIPANT HEALTH & FITNESS
Customer is responsible for determining whether participants are physically capable of safely participating in the activities associated with the rented equipment.
Participants should not use the equipment if they are experiencing a condition that makes participation unsafe.

13. PERSONAL PROPERTY
Turf Wars is not responsible for personal belongings that are lost, stolen, damaged, or left near or around the rental equipment or event area.

14. PHOTOGRAPHS & EVENT CONTENT
Unless separately agreed upon, Turf Wars is not responsible for photographing or supervising participants.
If Customer provides photographs or videos to Turf Wars for promotional purposes, Customer represents that they have obtained any permissions necessary to provide those materials to Turf Wars.

15. ACKNOWLEDGMENT
By signing below, Customer acknowledges that they:
Have read and understand this Agreement;
Understand that recreational activities involve inherent risks;
Voluntarily accept responsibility for the proper use of the rental equipment;
Agree to follow Turf Wars' instructions and safety requirements;
Accept responsibility for damage, loss, or theft of equipment as described above;
Agree to the release and hold-harmless provisions contained in this Agreement to the fullest extent permitted by law; and
Understand that they are responsible for ensuring that all participants and guests use the equipment safely and appropriately.
